With hate crime it is \u2018who\u2019 the victim is, or \u2018what\u2019 the victim appears to be that motivates the offender to commit the crime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A hate crime is defined as &#8216;Any criminal offence which is perceived by the victim or any other person, to be motivated by hostility or prejudice based on a person&#8217;s race or perceived race; religion or perceived religion; sexual orientation or perceived sexual orientation; disability or perceived disability and any crime motivated by hostility or prejudice against a person who is transgender or perceived to be transgender.&#8217;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A hate incident is any incident which the victim, or anyone else, thinks is based on someone\u2019s prejudice towards them because of their race, religion, sexual orientation, disability or because they are transgender.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Not all hate incidents will amount to criminal offences, but it is equally important that these are reported and recorded by the police.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Evidence of the hate element is not a requirement. You do not need to personally perceive the incident to be hate related. It would be enough if another person, a witness or even a police officer thought that the incident was hate related.<\/span><\/p>\n<h2><b>Types of hate crime<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Hate crime can fall into one of three main types: physical assault, verbal abuse and incitement to hatred.<\/span><\/p>\n<h2><b>Physical assault<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Physical assault of any kind is an offence. If you\u2019ve been a victim of physical assault you should report it. Depending on the level of the violence used, a perpetrator may be charged with common assault, actual bodily harm or grievous bodily harm.<\/span><\/p>\n<h2><b>Verbal abuse<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Verbal abuse, threats or name-calling can be a common and extremely unpleasant experience for minority groups.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Victims of verbal abuse are often unclear whether an offence has been committed or believe there is little they can do. However, there are laws in place to protect you from verbal abuse.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you\u2019ve been the victim of verbal abuse, talk to the police or one of our partner organisations about what has happened. You\u2019ll find a list of them on our&nbsp;<\/span><a href=\"https:\/\/www.met.police.uk\/advice\/advice-and-information\/hco\/hate-crime\/how-to-report-hate-crime\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">How to report hate crime<\/span><\/a><span style=\"font-weight: 400;\">&nbsp;page.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Even if you don\u2019t know who verbally abused you, the information could still help us to improve how we police the area where the abuse took place.<\/span><\/p>\n<h2><b>Incitement to hatred<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The offence of incitement to hatred occurs when someone acts in a way that is threatening and intended to stir up hatred. That could be in words, pictures, videos, music, and includes information posted on websites.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Hate content may include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">messages calling for violence against a specific person or group<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">web pages that show pictures, videos or descriptions of violence against anyone due to their perceived differences<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">chat forums where people ask other people to commit hate crimes against a specific person or group<\/span><\/li>\n<\/ul>\n<h2><b>How to report a hate crime<\/b><b>&nbsp;<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">&nbsp;By reporting&nbsp;<\/span><a href=\"https:\/\/www.met.police.uk\/advice\/advice-and-information\/hco\/hate-crime\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">hate crime<\/span><\/a><span style=\"font-weight: 400;\">, you may be able to prevent it from happening again.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Is it an emergency?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Does it feel like the situation could get heated or violent very soon? Is someone in immediate danger? Do you need support right away? For example, if it took place&nbsp;in a train station, British Transport Police (BTP) would be the right force; we&#8217;d send them your report and they&#8217;d investigate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Once we know we\u2019re the right police force to investigate, we\u2019ll give you a crime reference number. How quickly we can do this depends on the type of crime and the number of other authorities involved in the case.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We\u2019ll then look at the information we&#8217;ve got and decide if we can investigate your report further. If we decide we can&#8217;t investigate your report, we&#8217;ll contact you to explain why.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Our decision is based on four key factors:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">vulnerability of the victim (eg is the victim in danger?)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">seriousness of the crime<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">likelihood of solving it<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">best use of our resources&nbsp;<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If we can investigate further, we&#8217;ll take some initial steps. These could include:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">talking to witnesses<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">assessing the crime scene<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">checking CCTV or video footage&nbsp;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">searching our intelligence database (to see if other crimes have happened in the area, or if we hold information related to the case)<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">After we\u2019ve done an initial investigation<\/span><\/p>\n<p><span style=\"font-weight: 400;\">There are two possible outcomes:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">We\u2019ll close the investigation<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">We\u2019ll move forward with the investigation<\/span><\/li>\n<\/ol>\n<p><span style=\"font-weight: 400;\">When we\u2019ve made a decision, we&#8217;ll contact you to let you know.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Closing an investigation<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If we close the investigation, it\u2019s probably because we&#8217;ve completed our initial steps and there are no other leads we can follow at that time.&nbsp;<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sometimes we get new information or discover new evidence, in which case we can reopen the investigation and update you.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Whether or not this happens, your report and the information we have is valuable. It helps decide where and when we use police resources to track down and prevent crime.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Moving forward with an investigation<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We\u2019ll assign an investigating officer to you. This happens either after they\u2019ve been arrested or because they\u2019ve volunteered to be interviewed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cases you can ask to be reviewed<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You have the right to request a review if the police decide:<\/span><\/p>\n<p><span style=\"font-weight: 400;\">not to charge someone<\/span><\/p>\n<p><span style=\"font-weight: 400;\">or<\/span><\/p>\n<p><span style=\"font-weight: 400;\">where the police decide that the case doesn\u2019t meet the test for the Crown Prosecution Service (CPS) to decide to charge someone<\/span><\/p>\n<p><span style=\"font-weight: 400;\">VRR only applies where the decision is made not to charge or not to pass the case to the CPS to make a decision to charge someone.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It doesn\u2019t cover decisions on whether a crime is recorded or whether an investigation into a crime can continue. If the CPS decides not to charge someone,&nbsp;<\/span><a href=\"https:\/\/www.cps.gov.uk\/victims-witnesses\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">their website explains<\/span><\/a><span style=\"font-weight: 400;\">&nbsp;what you can do.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Cases that can\u2019t be reviewed<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">VRR doesn\u2019t apply to cases where:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a suspect hasn\u2019t been identified and interviewed<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">only some of the charges are brought against some of the suspects<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a positive decision has been made about someone else in connection with the incident. This could include a range of outcomes. For example, community resolutions or a caution, through to charge and a court appearance<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the suspect is charged with a different crime from the one that was recorded and complained about by the victim. For example, the suspect is charged with common assault but an offence of actual bodily harm was recorded<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the case has been closed<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the victim withdraws their complaint, or refuses to cooperate with the investigation, so police decide not to charge or to refer the case to the CPS<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Sometimes an investigation into an offence is ongoing, so even though police have made a decision on whether to charge someone, a VRR consideration may be postponed until the investigation is complete.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The scheme applies to any decision made on or after 1 April 2015.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If your request to review relates to the CPS VRR scheme, you can request a review on a decision made on or after 5 June 2013. As this is a CPS scheme, the right to review lies with them. These include:&nbsp;<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">close relatives of someone who has died as a result of a crime<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the parent or guardian of a victim who is under the age of 18<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">someone who is representing a victim who has a disability or who has been badly injured as the result of a crime which means they can\u2019t represent themselves<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">a business<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">You can ask someone to act on your behalf, such as a solicitor or Member of Parliament (MP). The officer\u2019s role is not to review the previous decision, but to take a fresh look at the evidence and to make their own decision.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">A review is usually completed within 30 working days. In complex or sensitive cases, it may take longer. You will be given regular updates.<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">Outcomes of reviews<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">There are six potential outcomes of a review:<\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the new officer reviewing the case agrees with the first decision<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the new officer disagrees with the first decision and the suspect is charged by the police, or the decision to charge is sent to the CPS<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the original decision is overturned and the suspect dealt with out of court (an out of court disposal). An officer will ask you questions to find out exactly what happened or what you know.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">We&#8217;ll try to arrange a convenient time and place for you to give your statement. It could be at a police station, your home or at work.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you have difficulty understanding or speaking English, you can ask for an interpreter. This means what you&#8217;re saying in your statement is true to the best of your knowledge.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Your witness statement may be used as evidence in court.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">You don&#8217;t have to give a statement but you might still be asked to go to court and say what you know.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Victim Personal Statement (VPS)<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you&#8217;re a victim, as well as giving a witness statement, you can also give a&nbsp;<\/span><a href=\"https:\/\/www.gov.uk\/government\/publications\/victim-personal-statement\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Victim Personal Statement (VPS)<\/span><\/a><span style=\"font-weight: 400;\">. They can help explain things to you and look at what support you can get.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If you won&#8217;t go to court, you may get a &#8216;witness summons&#8217; from the court.
